Titel: Provision of Guard Vessels
Beschreibung: TenneT is looking for reliable, trustworthy and highly professional providers of Class B and Class C Guard Vessels (GV) and their respective crews to conclude a service framework contract for the duration of 3 years (+2 +2 years as options = 7 years max.). For the specific tasks, the Client distinguishes between and requires GV of Class B (max. speed min. 15 knots) and Class C (max. speed min. 10 knots). The minimum requirement is a contractor fleet of at least 3 Guard Vessels for each Class: Class B (maximum speed of at least 15 knots): 3 vessels minimum within the fleet or in direct access. Class C (maximum speed of at least 10 knots): 3 vessels minimum within the fleet or in direct access. A guard vessel (GV) is required by safety regulations during various scenarios. The scope of work of the GV is to guard certain nearshore or offshore areas, e. g. during cable repairs, to protect unburied cables and joints, UXO locations or to guard a platform during outage of navigational lights or similar. The main activities of the GV are permanent observation of surrounding vessel traffic and to inform all vessels in the vicinity about the present activities or dangers via public broadcasts or by other visual and non-visual instructions within their guarding area. In order to protect the confidentiality of the information provided by the client in the tender documents, it is mandatory to conclude a confidentiality Agreement as per "NDA" document provided for download via Mercell. Please send the signed and stamped copy to: dominik.schellhase@tennet.eu. After sending the NDA and a plausibility check by the Client, the Client will grant the interested parties access to the tender by Email. After registering for the tender at Mercell Source-to-Contract, you will find all tender documents for the call for competition phase as well as the offer phase under "Questionnaires", section "Call for Competition", question 1.2.1. The bidder can not deduce eligibility for participation only from signing and submitting the NDA. TenneT will only accept tenderers who successfully qualify during the call for competition phase to participate in the offer phase.

Zusätzliche Informationen: #Besonders geeignet für:selbst# The application documents must be submitted in digital form (in a standardised data format, e.g. PDF and MS Office format) exclusively via the Mercell platform. Pre-submission of application documents by email, fax or mail is not permitted and will lead to disqualification of the applicant and exclusion from the tender process. * The application for the call for competition must be submitted in due time and no later than by 10.06.2024 at 12:00 CET via the e-Award platform Mercell. Individual extensions of time will not be granted. * Requests to participate must be submitted in full by above deadline exclusively via Mercell in the sections provided for this purpose. Please use all forms provided on the Mercell online platform, which must be submitted with the tender application. Tender applications that are submitted late cannot be considered. Incomplete documents will lead to exclusion from the tender. * The selection of bidders who are invited to negotiations following successful submission of a bid is based on the award criteria in accordance with Section 5.1.10 and is limited to 3. * In accordance with § 57 SektVO, the contracting authority is authorised to discontinue the award procedure at any time. * The estimated total maximum value of any call-offs under this framework agreement is EUR 10,000,000.00 (see section 2.1.3. “Value”). For the avoidance of doubt, it is emphasized that this is merely an estimated value, taking into account all options and "worst-case" scenarios, which does not justify any claims against TenneT for call-offs up to the aforementioned maximum value. The value stated is purely indicative and must not be used as a guideline when submitting an offer. * The award of the contract is subject to changes in the legal and/or regulatory framework, rules and regulations in force at the time of publication of this announcement. * The exercise of any call-offs under this framework agreement is subject to the proviso that the necessary approvals for the realisation of the projects have been obtained or the corresponding projects in the network development plan have been finally confirmed. * Companies affiliated with the contracting authority within the meaning of §§ 15 ff. AktG (even if they are only founded after conclusion of the framework agreement). Call-offs under this agreement are made in particular by the contracting authority (TenneT Offshore GmbH) and/or one of its affiliated companies. * The Principal is authorised to transfer the rights and obligations of the subject matter of the contract as a whole to a project company (Special Purpose Vehicle/NewCo), irrespective of whether third parties have already participated as shareholders in this project company or will only participate in such a company after any transfer of this Framework Agreement. * Technical questions regarding the use of Mercell can be addressed directly to the Mercell ServiceDesk: E-mail: support-nl@mercell.com Telephone: +31 (0)85-001 4593 Availability: 9:00 to 17:00 * Methodology for the general evaluation of offers and BAFO offers: For each criterion - except for the evaluation criterion "price", which will be dealt with separately - a comparative evaluation will be carried out and the bidders will be ranked according to their performance within this criterion. The ranking is then multiplied by the weighting of the respective criterion. The weighted rankings of all criteria are added together. The bidder with the best overall ranking is deemed to be the most economically favourable bidder and will be awarded with the first place. Price: The price criterion is based on the following evaluation: The tender with the lowest tender price will be ranked 1.00. Any tender that exceeds 2 times the lowest tender price is ranked last, whereby this always corresponds to the number of tenders submitted and evaluated. The evaluation for the bid prices in between is carried out using linear interpolation with up to two decimal places. Contractual conditions: The negotiation results within the framework of the award procedure are evaluated with regard to the final distribution of contractual risks to the disadvantage of the TenneT in comparison to TenneT's draft. If there are no specifications from TenneT, the results of the negotiations are assessed comparatively. Technical Ability & Availability: The results of the negotiations within the framework of the award procedure are evaluated with regard to the final concept submitted by the bidders in terms of the overall service design in all areas required by TenneT. The results of the negotiations are evaluated comparatively. * Note on Review Procedure: Applicants/bidders must complain about violations of procurement law in compliance with the provisions of Section 160 (3) ARC - Act against Restraints of Competition (GWB – Gesetz gegen Wettbewerbsbeschraenkung). An application for review is inadmissible pursuant to Section 160 (3) ARC if 1. the applicant has recognised the alleged violation of procurement law before filing the application for review and has not notified the contracting authority within a period of ten calendar days; the expiry of the time limit pursuant to Section 134 (2) ARC remains unaffected, 2. infringements of procurement law which are apparent from the EU notice are not notified to the contracting authority at the latest by the expiry of the time limit for application or submission of tenders stated in the notice, 3. infringements of procurement law which are only apparent in the tender documents are not notified to the contracting authority at the latest by the expiry of the time limit for application or submission of tenders, 4. more than 15 calendar days have elapsed after receipt of the contracting authority's notification that it does not intend to remedy a complaint.
