DLR Experiments on a CubeSat
With this project DLR intends to operate a scientific CubeSat mission in near earth orbit (LEO) in order to carry out the innovative research experiments ADS-B, DLReps, SCOSA and Retro Reflector.
The requested baseline tasks of this procurement include the supply of the satellite platform (Flight Model) and the Electrical Functional Model (EFM)/Flatsat and associated services and tasks
With this project DLR intends to operate a scientific CubeSat mission in near earth orbit (LEO) in order to carry out the innovative research experiments ADS-B, DLReps, SCOSA and Retro Reflector.
The requested baseline tasks of this procurement include the supply of the satellite platform (Flight Model) and the Electrical Functional Model (EFM)/Flatsat and associated services and tasks described below.
Further the Contractor shall indicate the cost for launch procurement as an option.
Delivery Items and Services * Satellite Flight Model (with integrated payloads) including transport and integration on the launch vehicle * Electrical Functional Model (EFM)/Flatsat used for payload and ground segment tests to be provided until end of mission * Complete Documentation defined in the Document Requirement List * TMTC Database including limits and ranges (e.g. Mission Information Base - data import into SCOS-2000 run-time database) * Flight Operations Procedures (compatible with the flight operational language e.g. MOIS, tcl-scripts, xmls) * Spacecraft System Engineering to perform the mission * Qualification of the Space Segment * Payload System Engineering support (Coordination of interfaces between satellite platform and the payloads) * AIT - Assembly, Integration and Test of the Space Segment.

The specialists from the spacecraft manufacturer will get in touch with the operations team in case of anomalies when a special expertise is needed for problem solving and trouble shooting. In most cases this support can be delivered off-console/off-line but the specialists are also prepared to travel to the control center if needed. Further the Contractor shall support TM evaluation and in-orbit engineering.
Launch [Optional] Procurement of the Launch by the Contactor including all contractual tasks needed.
Further information can be found in the attached Specification of Services, Document-No. DLR-SOW-0001, dated 24.11.2022 (contract documents).
In accordance with the stipulations set out in the contract notice text, the contracting authority will select a maximum of 5 candidates for the subsequent procedure. However, fewer candidates may be invited to submit tenders if the level of suitability of the candidates is inadequate. If the review of the Applications to Participate should reveal that more than 5 candidates possess the required ability, the contracting authority will select those candidates who best satisfy the required suitability conditions on the basis of the following criteria and their sub-criteria, whereby the Application to Participate with the highest total number of weighted points represents the best candidates:
Selection according to the reference projects.
Procurement of the Launch by the Contactor including all contractual tasks needed.
Abschnitt III: Rechtliche, wirtschaftliche, finanzielle und technische Angaben
The candidate must attach a company profile with the following information to the participation documents:• Company foundation date• Locations of the company • Legal form of the company • Range of customers• Description of the core business • Proof of entry in a professional or commercial register. Proof is provided by a current extract from the register or a copy thereof (the extract should not be older than three months at the time of the deadline) or a comparable document. Foreign tenderers can prove their registration in the respective professional or commercial register of their country of domicile by submitting corresponding documents in accordance with the local provisions. (Cf. Suitability Form, Section IV. 1)
• Candidates are to state the turnover of the last three completed financial years.
The proof is provided by means of a self-declaration of the total turnover for the last three financial years on the Suitability Form under Section II. 1.).
• Candidates must provide proof of professional/business liability insurance with a minimum coverage per insured event of 10.000.000 Euro for personal injury and for property and financial losses. The proof is provided by means of a self-declaration on the Suitability Form under Section II. 2.) as well as the submission of an insurance certificate issued by the insurer or a written declaration of the insurer that it is prepared to conclude an insurance contract in accordance with the notice in the event that an order is placed. The proof or declaration must not be more than 12 months old.
Bidding consortia must submit corresponding proof or a declaration for the bidding consortium or for each member of the bidding consortium.
• Declaration on employee development for the last three (3) completed financial years (to be completed on the Suitability Form under Section III.2).
• Indication of maximum five references that are comparable with this contract

The contracting authority will then carry out a check with respect to the non-existence of grounds for exclusion,
as well as any self-cleansing in accordance with Section 125 of the ARC (Act against Restraints of Competition) and, if necessary, take a decision on the exclusion of the candidates in accordance with the legal requirements.
Proof is provided by the declaration on the grounds for exclusion pursuant to Sections 123, 124 of the ARC.

An application for review is only admissible if * the applicant has notified the contracting authority of any infringements of procurement regulations identified by him in the procurement procedure within 10 calendar days of becoming aware of them,
* the applicant has notified the contracting authority of violations of procurement regulations which are recognizable on the basis of the notice, at the latest by the expiry of the deadline for application specified in the notice,
* the applicant has notified the contracting authority of violations recognizable in the tender documents no later than by the expiry of the deadline for submission of tenders,
* no more than 15 calendar days have elapsed since receipt of the contracting entity's notification of its intention not to remedy a complaint.
2020/S 026-059398 An application for review shall be inadmissible if more than 15 calendar days have elapsed after receipt of the contracting entity's notification that it does not intend to remedy a complaint (Section 160 (3) sentence 1 no. 4 ARC). An application for review is also inadmissible if the award has been made before the Procurement Chamber has informed the contracting authority of the application for review (Sections 168 (2) sentence 1, 169 (1) GWB). The contract may be awarded 15 calendar days after the bidder information has been sent pursuant to Section 134 (1) GWB. If the information is sent electronically or by fax, the period shall be reduced to 10 calendar days (Section 134 (2) GWB). The time limit begins on the day following the dispatch of the information by the contracting authority; the day of receipt by the tenderer and candidate concerned is irrelevant. The admissibility of an application for review further requires that the alleged infringements of public procurement law were notified 10 calendar days after knowledge thereof (Section 160 (3) sentence 1 no. 1 ARC). Infringements of procurement rules which are apparent from the notice must be notified to the contracting authority no later than the expiry of the period for application or submission of bids stated in the notice (Section 160 (3) sentence 1 no. 2 ARC). Infringements of procurement regulations which are only apparent in the award documents must be notified to the contracting authority by the the contracting authority no later than the expiry of the period for submitting applications or bids (Section 160 (3) sentence 1 no. 3 ARC).
