BACKUP Health is commissioned by the German Federal Ministry for Economic Cooperation and Development (BMZ), by Swiss Development Cooperation (SDC) since 2013 as well as by the UK Foreign, Commonwealth & Development Office (FCDO) and Expertise France since 2020. It is implemented by the Gesellschaft für Internationale Zusammenarbeit (GIZ) GmbH.
As of April 2020, BACKUP Health started a new project module that runs until August 2023. The project supports capacity development of state and non-state actors in selected partner countries to leverage funding from the Global Fund to fight AIDS, Tuberculosis and Malaria (GF/GFATM) and other global financing mechanisms, such as the Vaccine Alliance (Gavi) and the Global Financing Facility (GFF), in order to strengthen the country"s health systems and provide integrated preventive and curative health services. Through Providing for Health (P4H), BACKUP Health supports countries in improving strategic conditions for implementing health financing reforms. Furthermore, the project just started providing support on improving the framework conditions for vaccine production on the African continent.
With this tender of lots, BACKUP Health calls for assistance in the swift formulation and/or management of technical assistance (TA) assignments in countries eligible to BACKUP Health support. This tender of lots comprises of the following two lots:
Lot 1: Global Fund Funding Request and Re-programming Support
Under this lot, the contractor"s overall objective is to assist BACKUP Health in the provision of support to eligible countries through the timely deployment and management of international experts. Deployed experts shall support the development of a technically sound and successful GF funding request or re-programming application for one or several of the following (non-) disease-specific grants and catalytic investments: HIV, TB, Malaria, combined grants, RSSH, C19RM, regional grants, Matching Funds Request, Strategic Initiatives, PAAR (Prioritised Above Allocation Request).

Lot 1: Global Fund Funding Request and Re-programming Support
BACKUP Health provides technical assistance (TA) to GF grant implementers and Country Coordinating Mechanisms (CCM). The project receives support requests from GF applicant countries and their respective authorities, inter alia, Ministry of Health, National HIV/AIDS, Tuberculosis, Malaria, or RSSH Programme, the national authority entrusted with managing the COVID-19 pandemics, and the CCM or an equivalent nationalised entity. The latter serves as the national multi-stakeholder platform responsible for coordinating and overseeing grant implementation to support the preparation of GF funding requests and re-programming applications.
In the GF"s current funding cycle for 2020-2022, support requests from countries for re-programming can be expected on a rolling basis. The likelihood for BACKUP Health to receive such requests is growing once countries approach half-time or the end of the second year of their 3-year GF grants. Assistance requests for the development of C19RM grants is dependent on the C-19 situation in the countries and tied to the GF"s decision to announce further C19RM rounds. TA requests for the development of GF funding requests that respond to allocation letters for the upcoming funding cycle for 2023-2025, are expected to come in starting end of 2022 and early 2023, depending on the respective windows of submission for the countries eligible to BACKUP Health support.
BACKUP Health"s modus operandi to respond to the above-mentioned support requests is to provide TA through the deployment of international experts. The contractor"s overall objective is to assist BACKUP Health in the provision of support to eligible countries through the timely deployment and management of international experts. Abschnitt III: Rechtliche, wirtschaftliche, finanzielle und technische Angaben
The offer must be made using the forms provided by GIZ:
1) Trading name and address, beneficial owner(s), commercial register number, bank account, tax number, VAT identification number, brief company profile and contact in event of queries.
2) Extract from the commercial register or equivalent evidence/proof (not older than six months).
3) Self-declaration that no grounds for exclusion in Section 123, 124 of the German Act Against Restraints of Competition (GWB) apply.
4) If a candidate/tenderer wishes to use the capacities of another company for the execution of the contract, he must prove by submitting a declaration of commitment that the corresponding capacities are available to him for the execution of the contract.
5) If subcontractors are to be used, a declaration of commitment and a declaration that no grounds for exclusion pursuant to Section 123 GWB and/or Section 124 GWB apply to them must be submitted.
6) In the case of participation as a bidding consortium: tenderers must appoint a leading member and authorise this member to represent the group and to receive payments with discharging effect also for the other members. A corresponding agreement, signed by all members, must be attached to the application for participation. For this purpose, the form provided by GIZ must be used.
1) Declaration on the average annual turnover for the last 3 financial years (last-but-4 financial year can be included in case of invitation to tender held within 6 months of end of last financial year).
2) Declaration on the average number of employees and managers for the past three calendar years.

It is necessary to provide minimum 3 reference projects in the technical field "Health System Strengthening" and at least 3 reference project must be in Africa, each of them in the last three years with a minimum commission value of at least [Betrag gelöscht] EUR.
1) The technical assessment is only based on reference projects with a minimum commission value of 100,000 (one hundred thousand) EUR in the last three years.
2) The minimum requirements forsee at least 3 reference projects in the technical field "in collaboration with/concerning the Global Fund (GFATM)" and at least 2 reference project must be in Africa, each of them in the last three years with a minimum commission value of at least [Betrag gelöscht] EUR.

According to Article 160, Section 3 of the German Act Against Restraint of Competition (GWB), application for review is not permissible insofar as
1. the applicant has identified the claimed infringement of the procurement rules before submitting the application for review and has not submitted a complaint to the contracting authority within a period of 10 calendar days; the expiry of the period pursuant to Article 134, Section 2 remains unaffected,
2. complaints of infringements of procurement rules that are evident in the tender notice are not submitted to the contracting authority at the latest by the expiry of the deadline for the application or by the deadline for the submission of bids, specified in the tender notice.
3. complaints of infringements of procurement rules that first become evident in the tender documents are not submitted to the contracting authority at the latest by the expiry of the deadline for application or by the deadline for the submission of bids,
4. more than 15 calendar days have expired since receipt of notification from the contracting authority that it is unwilling to redress the complaint.
Sentence 1 does not apply in the case of an application to determine the invalidity of the contract in accordance with Article 135, Section 1 (2). Article 134, Section 1, Sentence 2 remains unaffected.
