The project ‘Support the Development of the Ethiopian Private Sector (SDEP)’ aims to improve the growth opportunities for the Ethiopian private sector, especially for micro-, small and medium-sized enterprises (MSMEs), start-ups and small and growing companies (SGBs). It does so in particular by strengthening institutional and other key actors in the field of private sector development and innovation. The project consists of four outputs:
1) Public institutions act in a way that promotes business;
2) Chambers and associations are strengthened;
3) Intermediaries in the innovation ecosystem are strengthened;
4) The range of services offered by business development services (BDS) providers is improved.
This tender covers an essential part of Output 1.
Output 1 aims to ensure that technical and managerial staff of public institutions with an influence on private sector development act in a more pro-business manner, thereby creating a better regulatory and legal environment. The involvement of the private sector in the drafting of legislation and regulations helps to ensure that the latter are more closely aligned with the needs of businesses. This impact hypothesis also applies to the participation of women-owned enterprises or their representatives and the consideration of their needs. The reformed regulations can also be used by companies through improved services provided by public institutions. Services provided by the Ethiopian government to mitigate the impact of the Covid-19 pandemic on MSMEs help stabilize the business environment, benefiting the broader economy.

The overall objective of this assignment is to implement an essential part of output 1 (‘Strengthening of public institutions’).
The contractor is responsible for achieving Output indicator 1.1 ‘(at least) 6 regulations, directives, guidelines, etc. are prepared up to final approval’ and Output indicator 1.2 ‘(at least) 6 measures at (at least) 2 institutions are implemented, of which 2 measures at regional level organisations.’ Furthermore, the contractor indirectly contributes to module objective indicators.
In addition to strengthening key institutions at the national level (in particular MoTI, FeSMMIPA, and MInT), the project also plans to implement activities outside of Addis Ababa in selected Ethiopian regions and strengthen relevant institutions there.
As the overall reform process may not develop in a linear way and cannot be planned in full detail, the assignment requires a flexible, iterative and adaptive approach on the part of the contractor.
The main work packages of the contractor are:
Work package 1: Change Management at public institutions.
The contractor is responsible for designing, initiating and accompanying a change management process at selected public institutions at national and regional levels.
Activities include:
— assessing organisational needs and gaps of the institutions;
— developing a concept and implementation plan for change management jointly with partner institutions; identifying desired results; developing standard operating procedures (SOP) to bring about the desired change.
Work package 2: capacity development of public institutions for strategy development and implementation, including public-private dialogue and knowledge management system.
This work package includes technical support to public institutions for strategy development and particularly effective strategy implementation.
Activities under work package 2 include:
— assessment of the existing strategy and regulatory framework for MSMEs and start-ups;
— identify needs for capacity development for better strategy implementation (regarding planning, organisation, skills and talent, internal processes, coordination, etc.).
Work package 3: coordination of government agencies
The tenderer is required to develop a proposal for better coordination between government agencies that support businesses in Ethiopia, with the aim of a better harmonisation of processes, services, strategies and strategy implementation.
Activities include:
— map key public institutions and development agencies alongside support to SMEs, start-ups and SGBs in Ethiopia;
— assessment of the current status of coordination mechanisms between government agencies responsible for SMEs and start-ups.
Work package 4: improved public services and ease of doing business
Activities under work package 4 include:
— assessment of existing services offered by public institutions (MoTI, FeSMMIPA, MInT) for SMEs and start-ups (based on existing assessments) and how they compare to the services offered by other actors (in particular those addressed in outputs 2, 3 and 4);
— technical advice on packaging (developing modules of) SME support services classified based on levels of growth of SMEs; mapping internal work processes to deliver these services sequentially and efficiently.

Abschnitt III: Rechtliche, wirtschaftliche, finanzielle und technische Angaben
1) Trading name and address, commercial register number;
2) Eligibility declaration that no grounds for exclusion in Section 123, 124 of the German Act Against Restraints of Competition (GWB) apply;
3) Eligibility declaration subcontractors if applicable;
4) Association clause if applicable.
1) Average annual turnover for the last 3 years (last-but-four financial year can be included in case of tenders held within 6 months of end of last financial year), at least: EUR 3 000 000;
2) Average number of employees and managers in the last 3 calendar years, at least 15 persons.
1) The technical assessment is only based on reference projects with a minimum commission value of EUR [Betrag gelöscht] EUR;
2) At least 4 reference projects in the technical field Institutional capacity building for private sector development of which (at least) 1 including change management and/or organisational development and and (at least) 1 including the promotion of public-private dialogue for improved business environment.
Out of the total of (at least) 4 reference projects in the above mentioned technical field at least 2 reference projects in Sub-Saharan Africa (all but Northern Africa) including (at least) 1 n East Africa in the last 3 years.

According to Article 160, Section 3 of the German Act Against Restraint of Competition (GWB), application for review is not permissible insofar as
1) The applicant has identified the claimed infringement of the procurement rules before submitting the application for review and has not submitted a complaint to the contracting authority within a period of 10 calendar days; the expiry of the period pursuant to Article 134, Section 2 remains unaffected;
2) Complaints of infringements of procurement rules that are evident in the tender notice are not submitted to the contracting authority at the latest by the expiry of the deadline for the application or by the deadline for the submission of bids, specified in the tender notice;
3) Complaints of infringements of procurement rules that first become evident in the tender documents are not submitted to the contracting authority at the latest by the expiry of the deadline for application or by the deadline for the submission of bids;
4) More than 15 calendar days have expired since receipt of notification from the contracting authority that it is unwilling to redress the complaint.
Sentence 1 does not apply in the case of an application to determine the invalidity of the contract in accordance with Article 135, Section 1 (2). Article 134, Section 1, Sentence 2 remains unaffected.
