81270696 — FTA Feasibility Studies for Cambodia
The ARISE Plus Cambodia project aims to support greater connectivity and economic integration between Cambodia and the rest of ASEAN through implementing the AEC Blueprint 2025 and strengthening institutional capacity. The project has 3 components:
1) Trade facilitation and standards;
2) Institutional and human capacities development for the formulation and implementation of trade-related policies;
3) Enhancement of private sector engagement, notably SMEs, and better preparedness for AEC's seamless, single economic space. ARISE Plus Cambodia is co-financed by the European Union (EU) and the German Federal Ministry for Economic Cooperation and Development (BMZ) with a budget of EUR 9 350 000, with a duration from January 2019 through June 2023.

This tender concerns series of three Free Trade Agreement (FTA) Feasibility Studies for Cambodia to support its upcoming bilateral trade negotiations with various partner countries, as a complement to ongoing capacity building conducted by the project on trade negotiation and trade policy development. The studies will also integrate a capacity building element to enable the Royal Government of Cambodia, particularly officials from the Ministry of Commerce and Ministry of Economy and Finance, to direct and utilize such studies in the future.
The assignment thus has two specific objectives:
1) The main objective is to provide information for Cambodian negotiators on the potential costs and benefits and priority issues for negotiating FTA with identified partners in terms of the agreement's coverage, based on some broad-based assumptions regarding the degree of liberalisation that would be agreed. Such studies should assist the Royal Government of Cambodia in making informed decisions on trade policy at large and in carrying out related trade negotiations;
2) A secondary yet important purpose of this assignment is to sustainably build
(a) the capacity of Cambodian negotiating team to understand the process of conducting FTA feasibility studies and to interpret the results of the analysis; and
(b) the local capacity within Cambodia to conduct future FTA feasibility studies.
The contractor will deliver 3 country-specific studies (NB: partner countries to be determined together with government partners by assignment start date), develop a Cambodia FTA Feasibility Study Manual of Procedures to guide future studies, organise dissemination workshops of the FTA studies in Phnom Penh, and provide ongoing capacity building to a study team of government officials.
The studies will consider not only the potential economic impacts of FTAs, but also the potential social and environmental impacts, from the Cambodian domestic perspective.
The contractor will deliver the above by the end of ARISE Plus Cambodia's project term (June 2023), using a mix of remote experts and locally based experts working on a part-time basis.

Abschnitt III: Rechtliche, wirtschaftliche, finanzielle und technische Angaben
1) Trading name and address, commercial register excerpt;
2) Eligibility declaration that no grounds for exclusion in Section 123, 124 of the German Act Against Restraints of Competition (GWB) apply;
3) Eligibility declaration subcontractors if applicable;
4) Association clause if applicable.

2) Declaration on the number of employees as at 31.12. of the previous year.

It is necessary to provide references in the technical field ‘assessing economic impacts of trade policy, labor policy or other economic policy’ with a minimum commission value of EUR 15 000.00.
1) At least 3 reference projects in the technical field ‘assessing economic impacts of trade policy, labor policy or other economic policy’ and at least 6 reference projects in Cambodia in the last 3 years;
2) The technical assessment is only based on reference projects with a minimum commission value of EUR 15 000.00.

According to Article 160, Section 3 of the German Act Against Restraint of Competition (GWB), application for review is not permissible insofar as
1) The applicant has identified the claimed infringement of the procurement rules before submitting the application for review and has not submitted a complaint to the contracting authority within a period of 10 calendar days; the expiry of the period pursuant to Article 134, Section 2 remains unaffected;
2) Complaints of infringements of procurement rules that are evident in the tender notice are not submitted to the contracting authority at the latest by the expiry of the deadline for the application or by the deadline for the submission of bids, specified in the tender notice;
3) Complaints of infringements of procurement rules that first become evident in the tender documents are not submitted to the contracting authority at the latest by the expiry of the deadline for application or by the deadline for the submission of bids;
4) More than 15 calendar days have expired since receipt of notification from the contracting authority that it is unwilling to redress the complaint.
Sentence 1 does not apply in the case of an application to determine the invalidity of the contract in accordance with Article 135, Section 1 (2). Article 134, Section 1, Sentence 2 remains unaffected.
