Context
In Ghana, current power generation capacity exceeds the country's national needs. One of the causes of this problem are long-term and expensive power purchase agreements that the state has concluded with private operators of thermal energy in the context of the energy crisis of 2014-2016. These result in high electricity prices, which not only represent a challenge for private households and the economic sector, but also lead to high public debt.
Thereby, investment into renewable energies become more difficult. However, the saving potential, both from an energy and financial point of view, is enormous. Other challenges in the sector are the inadequate professional qualification of personnel in the field of renewable energies and energy efficiency, which leads to a lack of qualified workers.
The bilateral project "Renewable Energy and Energy Efficiency for Climate Protection in Ghana" aims to improve the institutional and regulatory framework for renewable energy and energy efficiency and to promote investment in this area. The project also supports the objectives of the German-Ghanaian Reform and Investment Partnership.
Objective
The institutional and regulatory framework for the use of renewable energy and energy efficiency solutions has improved. This also improves the financial sustainability of the energy sector. In addition, the project supports the achievement of Ghana's climate goals and sustainable and inclusive economic development.
Approach
The project focuses on the following five areas: (i) advising the Ministry of Energy, (ii) improving the performance of state-owned energy supply companies, (iii) improving renewable energy and energy efficiency services of the Energy Service Center of the Ghanaian Industry Association (AGI), (iv) improving the energy efficiency and use of renewable energy solutions in public buildings, as well as (v) improving vocational training in the field of renewable energies and energy efficiency (this last output is not part of the tender).

This tender involves the supply and management of advisory services to the GIZ "Sustainable Energy and Energy Efficiency for Climate Protection" Project (SustainE4Climate) in Ghana around the topics of renewable energy and energy efficiency by a pool of short term experts. The contractor"s services will be part of the overall strategy and will therefore follow the same strategy and objectives which the project employs: Improving the conditions for the uptake and long-term implementation of renewable energy (mostly solar) and energy efficiency solutions. This entails work on the regulatory environment (mostly with the State), work with the public electricity utilities, work with the private sector (commerce and industry and the general industry umbrella organisation), work with the building sector in order to improve energy efficiency there. The strategy is a results-oriented approach that requires a high level of flexibility as much by GIZ as the tenderer.
The services requested here will be delivered by a pool of short term experts (both with international background as well as a national one) in form of technical services related to the key intervention areas of the project, which are:
o advice on and development of a regulatory framework for renewable energy and energy efficiency (Output 1)
o Renewable Energy-related business advice to state owned energy utilities (Output 2)
o advice regarding service delivery to the Energy Service Centre of the Association of Ghana business AGI (Output 3)
o advice on energy efficiency in buildings (Output 4)
o as well as cross-cutting areas such as process management, organisational development, monitoring & evaluation, gender mainstreaming, communication and presentation and workshop logistics.
The provided short term experts are expected to complement the project"s work with pinpointed/targeted expertise on specific topics, e.g. by producing concept papers, delivering feasibility studies, transferring proven and successful concepts from the field of renewable energy and energy efficiency to Ghana, and others.
GIZ may optionally commission contract amendments and/or increases based on the criteria in the tender documents to the successful bidder of this tender. For details, please see the terms of reference.

According to Article 160, Section 3 of the German Act Against Restraint of Competition (GWB), application for review is not permissible insofar as
1. the applicant has identified the claimed infringement of the procurement rules before submitting the application for review and has not submitted a complaint to the contracting authority within a period of 10 calendar days; the expiry of the period pursuant to Article 134, Section 2 remains unaffected,
2. complaints of infringements of procurement rules that are evident in the tender notice are not submitted to the contracting authority at the latest by the expiry of the deadline for the application or by the deadline for the submission of bids, specified in the tender notice.
3. complaints of infringements of procurement rules that first become evident in the tender documents are not submitted to the contracting authority at the latest by the expiry of the deadline for application or by the deadline for the submission of bids,
4. more than 15 calendar days have expired since receipt of notification from the contracting authority that it is unwilling to redress the complaint.
Sentence 1 does not apply in the case of an application to determine the invalidity of the contract in accordance with Article 135, Section 1 (2). Article 134, Section 1, Sentence 2 remains unaffected.
