The Private Sector Development & Employment Promotion (PSD) Project in Iraq is a multi-donor action commissioned by the German Federal Ministry for Economic Cooperation and Development (BMZ), co-funded by the European Union (EU) and implemented by the Deutsche Gesellschaft für Internationale Zusammenarbeit (GIZ) GmbH.
The PSD project supports governmental efforts of creating conditions for a growth-oriented business and investment climate in central and southern Iraq as well as in the Kurdistan region. It provides advisory services for economic reforms to government partners and supports fact-based policy making through promoting the inclusion of private sector representations, academic institutions and civil society organisations into policy-making processes.
In addition, PSD supports the creation of employment prospects in the private sector for young Iraqis, especially women and returnees, following an integrated approach that combines labour market-driven skills development and job placement measures as well as entrepreneurship development, and advisory services for MSMEs.
Overall, this multi-donor action puts emphasis on developing long-term abilities of its partners such as Ministry of Planning (MoP), Ministry of Higher Education and Scientific Research (MoHESR), Ministry of Labour and Social Affairs (MoLSA), chambers and business associations. Special attention is given to sectors with a strong potential for growth such as agri-business, solar energy, waste management, and hospitality, with a regional focus on Baghdad, Basra, Diwaniyah, Diyala, Erbil and Mosul.

The focus of this assignment is the targeted enhancement of policy analysis and design capacities of a small team of technical staff which will then be supervised in a process to create evidence-based, participatory and solution-oriented policy proposals. In the Iraqi context, the project intends to create two groups, one in the government of Federal Iraq in Baghdad (potential partners are the Ministry of Industry and Minerals, MoIM and the Ministry of Planning, MoP) and one in the private sector (Iraqi Federation of Industries, IFI), while simultaneously facilitating the technical collaboration between the two.
On this basis the contractor is to provide:
- Identification of partners within the supported institutions and narrowing down of the thematic focus area(s),
- Capacity development support for the representatives from the supported institutions,
- Facilitation support for the design of concrete policy proposals
- Support to organise public-private dialogues and collaboration, and
- Advocacy support for boosting awareness of policy needs and processes.
In this approach it is important to proceed in a strategically sequenced manner that on the one hand allows quick results while on the other hand doesn"t require large compromises in terms of the quality of the policy proposals.
The project uses the semi-formal approach of "economic policy innovation labs" This process is led by GIZ and involves technocrats from the government as well as technical staff from private sector organisations without aiming at an immediate formal establishment and institutional integration of new units from the start which would require significant administrative formalities and political buy-in. Once this informal approach delivers results, a formalisation can be considered.
The contractor is expected to set up an informal centre of excellence for "industrial policy advocacy" in the form of an innovation lab on the technical level within the Ministry of Industry and the Iraqi Federation of Industries (IFI). The key objective is to enhance the Ministry"s essential technical capacities that make industrial policy initiatives more effective, with a focus on evidence-based, participatory and goal-oriented policy making the IFI"s industrial policy advocacy capacities. This will enable them to lobby more effectively for required policy changes.

Abschnitt III: Rechtliche, wirtschaftliche, finanzielle und technische Angaben
The offer must be made using the forms provided by GIZ:
1) Trading name and address, beneficial owner(s), commercial register number, bank account, tax number, VAT identification number, brief company profile and contact in event of queries.
2) Extract from the commercial register or equivalent evidence/proof (not older than six months).
3) Self-declaration that no grounds for exclusion in Section 123, 124 of the German Act Against Restraints of Competition (GWB) apply.
4) If a candidate/tenderer wishes to use the capacities of another company for the execution of the contract, he must prove by submitting a declaration of commitment that the corresponding capacities are available to him for the execution of the contract.
5) If subcontractors are to be used, a declaration of commitment and a declaration that no grounds for exclusion pursuant to Section 123 GWB and/or Section 124 GWB apply to them must be submitted.
6) In the case of participation as a bidding consortium: tenderers must appoint a leading member and authorise this member to represent the group and to receive payments with discharging effect also for the other members. A corresponding agreement, signed by all members, must be attached to the application for participation. For this purpose, the form provided by GIZ must be used.

It is necessary to provide minimum 4 reference projects in the technical field "industrial and economic policy advisory" and at least 1 reference project must be in the MENA region, each of them in the last three years with a minimum commission value of at least [Betrag gelöscht] EUR.
1) The technical assessment is only based on reference projects with a minimum commission value of 20,000 (twenty thousand) EUR in the last three years.
2) The minimum requirements forsee at least 4 reference projects in the technical field "industrial and economic policy advisory" and at least 1 reference project must be in the MENA region, each of them in the last three years with a minimum commission value of at least [Betrag gelöscht] EUR.

According to Article 160, Section 3 of the German Act Against Restraint of Competition (GWB), application for review is not permissible insofar as
1. the applicant has identified the claimed infringement of the procurement rules before submitting the application for review and has not submitted a complaint to the contracting authority within a period of 10 calendar days; the expiry of the period pursuant to Article 134, Section 2 remains unaffected,
2. complaints of infringements of procurement rules that are evident in the tender notice are not submitted to the contracting authority at the latest by the expiry of the deadline for the application or by the deadline for the submission of bids, specified in the tender notice.
3. complaints of infringements of procurement rules that first become evident in the tender documents are not submitted to the contracting authority at the latest by the expiry of the deadline for application or by the deadline for the submission of bids,
4. more than 15 calendar days have expired since receipt of notification from the contracting authority that it is unwilling to redress the complaint.
Sentence 1 does not apply in the case of an application to determine the invalidity of the contract in accordance with Article 135, Section 1 (2). Article 134, Section 1, Sentence 2 remains unaffected.
