The Nigeria Energy Support Programme (NESP) is co-funded by the European Union (EU) and the German Government - Bundesministerium für wirtschaftliche Zusammenarbeit und Entwicklung (BMZ) - and implemented by Deutsche Gesellschaft für Internationale Zusammenarbeit (GIZ) in collaboration with the Federal Ministry of Power (FMP). NESP, currently in its extended second phase (NESP II Extension) builds upon NESP I and NESP II Phase activities during which it supported the Federal Ministry of Power (formerly the Federal Ministry of Power, Works & Housing), on the development and launch of the Building Energy Efficiency Guideline (BEEG) in 2016, the Building Energy Efficiency Code (BEEC) in 2017 and the One Stop Investment Platform in 2020 geared towards fostering an enabling environment for energy efficiency and renewable energy investments in Nigeria. The project aims to facilitate the adoption and implementation of the BEEC through effective stakeholder negotiations, capacity development and demonstration projects, as part of key strategies towards fostering an enabling environment for energy efficiency and renewable energy in Nigeria.

During its first three years of second implementation phase, NESP II supported BEEC adoption activities at state-level. In addition, NESP supported private building developers with the implementation of the BEEC in their building design and construction, to achieve and demonstrate energy efficiency (EE). Part of the support included technical assistance with the development of energy efficient building designs which shall also serve as pilot projects to demonstrate the use/feasibility of EE and renewable energy (RE) materials, equipment and technologies in the Nigerian building sector (during NESP II Extension).
To build up on past achievements, NESP"s Unit on Enabling Environment for RE and EE Investments seeks a contractor to provide technical and advisory services to states in Nigeria as well as the private sector on the definition and activation of energy efficiency within the building and construction sector. Tasks include developing a technical study and recommendations to improve the current BEEC requirements; provide further support to scale up pilot EE housing projects through technical proposals advisory for access to finance for the private sector; and development of a web/mobile tool for easy compliance check of building designs. In addition, the contractor shall support with hands-on trainings and certifications (within the local context) on EE-related topics and also support activities targeting the legislation of the BEEC bill aimed at mandating the implementation of the BEEC in subsequent building designs.
All activities should consider adaptation to the COVID-19 restrictions for travel and physical activity. Planning meetings, missions and planned activities shall be carried out both physically and virtually, depending on the specific tasks. The contractor is expected to provide innovative strategies for project implementation.
It is possible to continue key elements of the service specified in the tender as part of a follow-on measure within the context of the basic project. This is described in detail below.
1. Due to the Covid-19 Pandemic, limited field costs for the experts are initially planned. If the situation changes, costs for field days (including travel expenses) for the consultants could be covered using Flexible Renumeration or included as part of a contract amendment, as applicable.
2. Within the framework of the basic project described in the ToR, GIZ reserves the right to award contracts for additional services of this type in a comparable extent to the successful company in this procedure by means of a negotiated procedure without a prior call for competition, or to enter into a follow-on contract (in the event of NESP III) pursuant to the criteria listed in the ToR and the contract.
A selection will be made under all eligible participants based on the following criteria:
1. Technical experience (50%)
- Energy Efficiency (EE) and Renewable Energy (RE) projects (10%)
- EE/RE training delivery and facilitation (10%)
- EE/Green building design and construction (10%)
- Building energy modelling (10%)
- Digital energy calculator and database tools (10%)
2. Regional experience in Africa (30%)
3. Experience of development projects (at least 50% ODA-financed) (20%)
GIZ may optionally commission contract amendments and/or increases based on the criteria in the tender documents to the successful bidder of this tender. For details, please see the terms of reference.

According to Article 160, Section 3 of the German Act Against Restraint of Competition (GWB), application for review is not permissible insofar as
1. the applicant has identified the claimed infringement of the procurement rules before submitting the application for review and has not submitted a complaint to the contracting authority within a period of 10 calendar days; the expiry of the period pursuant to Article 134, Section 2 remains unaffected,
2. complaints of infringements of procurement rules that are evident in the tender notice are not submitted to the contracting authority at the latest by the expiry of the deadline for the application or by the deadline for the submission of bids, specified in the tender notice.
