The Private Sector Development & Employment Promotion (PSD) project in Iraq is a multi-donor action commissioned by the German Federal Ministry for Economic Cooperation and Development, co-funded by the European Union and implemented by the Deutsche Gesellschaft für Internationale Zusammenarbeit (GIZ) GmbH.
The PSD project supports governmental efforts of creating conditions for a growth-oriented business and investment climate in central and southern Iraq as well as in the Kurdistan region. It provides advisory services for economic reforms to government partners and supports fact-based policy making through promoting the inclusion of private sector representations, academic institutions and civil society organisations into policy-making processes.
Overall, this multi-donor action puts emphasis on developing long-term abilities of its partners such as Ministry of Planning, Ministry of Higher Education and Scientific Research, Ministry of Labour and Social Affairs, chambers and business associations. Special attention is given to sectors with a strong potential for growth such as agri-business, solar energy, waste management, and hospitality, with a regional focus on Baghdad, Basra, Diwaniyah, Diyala, Erbil and Mosul.

The significant drop of crude oil prices to an 18-year low of less than $20 per barrel in April 2020 has, in addition to the COVID-19 pandemic, significantly affected the Iraqi economy. The annual budget for 2020 had been calculated with a minimum oil price of $60, hence, resulting in a massive lack of sufficient funds for paying wages in the public sector starting in May.
Based on these circumstances, the Iraqi government released the so-called white paper, a reform document including key solutions to develop and enhance the development process. The formal governance model consists of four levels: (1) the Council of Ministers as the ultimate decision-making entity, (2) the Higher Committee for Reform (HCR), as the dedicated leadership and (3) the Reform Management Cell (RMC) for strategic programme management and implementation oversight and (4) relevant government entities, implementing as per initiative charters within approved budget and timeframe. Additionally, an executive sub-committee of HCR is established. This hierarchy provides strategic direction, reviews progress, ensures government contribution and streamlining of approvals, manages reform implementation, identifies and mitigates risks and coordinates international support. The RMC will be primarily staffed from line ministries. This staff shall be supported when required with international consultants on a project basis, pairing Iraqi leads with international consultants.
The contractor is responsible to provide short-term experts in various fields, such as agriculture & agri-businesses, digitalisation & e-government, entrepreneurship, public financial management, (M)SME finance, banking, private sector development, customs & trade, taxation or privatisation & restructuring of state-owned enterprises.
When demand arises in a particular thematic area, consultants are called upon to provide demand-driven advisory services, access to knowledge and technical backstopping to RMC, other political partners and/or the project itself. The range of tasks for the consultants includes applied research, diagnostic missions, provision of strategic and operational advice, capacity assessment and capacity development activities, strategic development and implementation of projects and policies, on-site support to programme development, legislation drafting, negotiation and coordination with public/private partners and stakeholders, partnership development, civil society engagement and outreach including through social media, report drafting, peer review, and others. It is possible to continue key elements of the service specified in the tender as part of a follow-on measure within the context of the basic project. This is described in detail below.

According to Article 160, Section 3 of the German Act Against Restraint of Competition (GWB), application for review is not permissible insofar as
1. the applicant has identified the claimed infringement of the procurement rules before submitting the application for review and has not submitted a complaint to the contracting authority within a period of 10 calendar days; the expiry of the period pursuant to Article 134, Section 2 remains unaffected,
2. complaints of infringements of procurement rules that are evident in the tender notice are not submitted to the contracting authority at the latest by the expiry of the deadline for the application or by the deadline for the submission of bids, specified in the tender notice
3. complaints of infringements of procurement rules that first become evident in the tender documents are not submitted to the contracting authority at the latest by the expiry of the deadline for application or by the deadline for the submission of bids,
4. more than 15 calendar days have expired since receipt of notification from the contracting authority that it is unwilling to redress the complaint.
Sentence 1 does not apply in the case of an application to determine the invalidity of the contract in accordance with Article 135, Section 1 (2). Article 134, Section 1, Sentence 2 remains unaffected.
