81272663-Damage Assessment Study of the Urban Water Supply and Sanitation Situation in Yemen — Stage IV
The project ‘Institutional Development of the Water Sector IV — Addressing Basic Needs’ in Yemen is funded through the German Federal Ministry of Economic Cooperation and Development (BMZ). The overall objective of the project is to improve conditions for sustaining basic water supply and sanitation services for the population. A contractor is required to develop an updated, improved and extended Damage Assessment Study (DAS IV) by critically assessing the current situation and resilience of the urban water and sanitation services in Yemen, including the development of a resilience strategy and of investment and technical assistance plans for sustaining the water and sanitation services for the 35 main cities in Yemen. Since non-Yemeni experts are prohibited from working in Yemen due to the security situation, the contractor is required to recruit qualified national experts to conduct the study. International and regional experts shall be employed for remote steering and management of the study. Close coordination and consultation with the GIZ project team in Yemen and Germany will be required.

Work and services to be provided by the contractor include the following
1) Preparation of the study;
2) Data collection, assessment and analysis of urban water supply and sanitation situation;
3) Development of assessment reports with technical assistance and investment measures; and
4) Presentation of the study results and reports.
Due to the current security situation in Yemen non-Yemeni experts within GIZ assignments are prohibited to work in Yemen. Therefore, services of the contractor's team of international, regional and national experts shall be delivered through a combination of remote (for international and regional staff) and in country (for national staff) working modes. The contractor is required to work under the direct supervision of GIZ project director and liaise with the GIZ project team in Sana'a throughout the assignment. In addition, the Contractor shall arrange occasional meetings with national experts at locations outside Yemen (e.g. Jordan and/or Egypt) to enhance coordination with the GIZ team and partners from Yemen.
Planning for the study and damage assessment surveys must be performed in close collaboration with the GIZ team and with respective local stakeholders including partner institutions, aid organizations and donors. Under the umbrella of the GIZ project team in Yemen, representatives of key stakeholders will form an advisory board to facilitate the assignment of the contractor throughout the study.
Relevant stakeholders shall be included in the planning and implementation stage and stakeholder involvement shall be facilitated through interviews, meetings, and online communication. The contractor is further required to organise consultative workshops with stakeholders for the presentation and discussion of study results and reports.
The contractor may be a single firm with local branches or a consortium of various consulting firms. The involvement of local consulting firms from Yemen within subcontracting or joint venture arrangements will be permitted.
The overall duration of the contract shall be 14 months from award of contract (anticipated from November.2021 to 31 December 2022).

Abschnitt III: Rechtliche, wirtschaftliche, finanzielle und technische Angaben
The offer must be made using the forms provided by GIZ:
1) Trading name and address, beneficial owner(s), commercial register number, bank account, tax number, VAT identification number, brief company profile and contact in event of queries;
2) Extract from the commercial register or equivalent evidence/proof. (not older than 6 months);
3) Self-declaration that no grounds for exclusion in Section 123, 124 of the German Act Against Restraints of Competition (GWB) apply;
4) If a candidate/tenderer wishes to use the capacities of another company for the execution of the contract, he must prove by submitting a declaration of commitment that the corresponding capacities are available to him for the execution of the contract or are provided by this subcontractor;
5) In the case of participation as a bidding consortium: tenderers must appoint a leading member and authorise this member to represent the group and to receive payments with discharging effect also for the other members. A corresponding agreement, signed by all members, must be attached to the application for participation. For this purpose, the form provided by GIZ must be used;
6) Order form for registration of a creditor (in case of bidding consortium for all members of the consortium and the bidding consortium itself).
1) Declaration on the average annual turnover for the last 3 financial years (last-but-4 financial year can be included in case of invitation to tender held within 6 months of end of last financial year);
2) Declaration on the number of employees as at 31.12 of the previous year;
3) Evidence of creditworthiness may be requested from the bidder/bidding consortium who is to be awarded the contract after submission of the bid. The date of the evidence of creditworthiness must be no older than three months.
1) Average annual turnover for the last 3 financial years: at least EUR 1 500 000 (one million five hundred thousand Euro);
2) Number of employees as at 31.12 of the previous year: at least 15 persons.
It is necessary to provide three reference projects in the technical field ‘water and wastewater — infrastructure and capacity development’ and at least 4 reference projects must be in MENA region incl. Yemen, each of them in the last 3 years.
The technical assessment is only based on reference projects with a minimum commission value of EUR 250 000 (two hundred fifty thousand Euro) in the last 3 years:
The minimum requirements forsee
— at least 3 reference projects in the technical field ‘water and wastewater — infrastructure and capacity development’; and
— at least 4 reference projects must be in MENA region incl. Yemen.

According to Article 160, Section 3 of the German Act Against Restraint of Competition (GWB), application for review is not permissible insofar as
1) The applicant has identified the claimed infringement of the procurement rules before submitting the application for review and has not submitted a complaint to the contracting authority within a period of 10 calendar days; the expiry of the period pursuant to Article 134, Section 2 remains unaffected;
2) complaints of infringements of procurement rules that are evident in the tender notice are not submitted to the contracting authority at the latest by the expiry of the deadline for the application or by the deadline for the submission of bids, specified in the tender notice.
3) Complaints of infringements of procurement rules that first become evident in the tender documents are not submitted to the contracting authority at the latest by the expiry of the deadline for application or by the deadline for the submission of bids;
4) More than 15 calendar days have expired since receipt of notification from the contracting authority that it is unwilling to redress the complaint.
Sentence 1 does not apply in the case of an application to determine the invalidity of the contract in accordance with Article 135, Section 1 (2). Article 134, Section 1, Sentence 2 remains unaffected.
