The GIZ Commercial and Industrial Rooftop Solar (CIRTS) project in Viet Nam aims to improve the pre-conditions for the development of commercial rooftop solar energy (RTS) through the analysis and assessment of prevailing applicable standards, the development and adaptation of relevant regulatory and technical regulations for RTS, the development of key stakeholders' (power sellers and purchasers) capacities for RTS development, and to support the improvement of the Electricity Viet Nam's (EVN)'s information base for the development of RTS projects. GIZ and the Electricity and Renewable Energy Authority (EREA) of the Ministry of Industry and Trade (MOIT) in Viet Nam are jointly committed to work in three Action Areas:
1) Legal and regulatory frameworks;
2) Capacity development; and
3) Technology cooperation.
The contract to be tendered now will establish standing pools of highly-specialized experts to support the implementation of the CIRTS project for a period of twenty-four (24) months, with input of up to 1 980 expert days. Specifically, the consulting firm or consortium will provide International Senior Experts, International Junior Experts, and select Local Experts flexibly and on short notice to implement rooftop solar activities as agreed between GIZ CIRTS, its political partner EREA, and the project beneficiary EVN.

The GIZ Commercial and Industrial Rooftop Solar (CIRTS) project in Viet Nam aims to improve the pre-conditions for the development of commercial rooftop solar energy (RTS) through the analysis and assessment of prevailing applicable standards, the development and adaptation of relevant regulatory and technical regulations for RTS, the development of key stakeholders' (power sellers and purchasers) capacities for RTS development, and to support the improvement of the Electricity Viet Nam's (EVN)'s information base for the development of RTS projects. Relevant Work Packages cover technical topics including:
1) Rooftop solar and grid integration of variable renewable energy;
2) Power system and grid planning;
3) Integrated energy sector planning;
4) Energy policy and regulatory frameworks; and
5) Knowledge management, monitoring and evaluation.
Because all activities ultimately must be agreed with the political partner and beneficiaries, and given the historically dynamic energy situation in Viet Nam, it is not possible to specify a more detailed work plan at this point. It is important that the consulting firm or consortium provide its professional perspective on activity development and implementation in the Viet Nam context, and essential that the consulting firm or consortium implement flexibly with regard to content and personnel.

It is possible to continue key elements of the service specified in the tender as part of of the basic CIRTS project.
Type and scope: The additional service will consist of tasks consistent with the Work Packages tendered, and the offered human resources concept.
1) Technical Experience
— rooftop solar systems and grid integrati on of variable renewable energy (25 % weighting),
— power system and electricity grid planning (20 % weighting),
— integrated energy sector planning (10 % weighting),
— policy and regulatory frameworks for renewable energy (10 % weighting),
— knowledge management, monitoring and evaluation (5 % weighting).
2) Regional experience in South-Eastern Asia (20 % weighting);
3) Experience of development projects (at least 50 % ODA-financed) (10 % weighting).
In case of need of extension/expansion of services GIZ reserves the right to award contracts for additional services of this type within the framework of the basic project described in the terms of reference to the successful company in this procedure.
Abschnitt III: Rechtliche, wirtschaftliche, finanzielle und technische Angaben
1) Trading name and address, commercial register number;
2) Eligibility declaration that no grounds for exclusion in Section 123, 124 of the German Act Against Restraints of Competition (GWB) apply;
3) Eligibility declaration subcontractors if applicable;
4) Association clause if applicable.
1) Average annual turnover for the last 3 years at least EUR 3 400 000.
2) Number of employees as at 31.12 of the previous year at least 20 persons.
1) At least 3 reference projects in the technical field ‘solar PV’ and at least 1 reference projects in the region South-Eastern Asia in the last 3 years.
2) The technical assessment is only based on reference projects with a minimum commission value of EUR 10 000.00.

According to Article 160, Section 3 of the German Act Against Restraint of Competition (GWB), application for review is not permissible insofar as:
1) The applicant has identified the claimed infringement of the procurement rules before submitting the application for review and has not submitted a complaint to the contracting authority within a period of 10 calendar days; the expiry of the period pursuant to Article 134, Section 2 remains unaffected;
2) Complaints of infringements of procurement rules that are evident in the tender notice are not submitted to the contracting authority at the latest by the expiry of the deadline for the application or by the deadline for the submission of bids, specified in the tender notice;
3) Complaints of infringements of procurement rules that first become evident in the tender documents are not submitted to the contracting authority at the latest by the expiry of the deadline for application or by the deadline for the submission of bids;
4) More than 15 calendar days have expired since receipt of notification from the contracting authority that it is unwilling to redress the complaint.
Sentence 1 does not apply in the case of an application to determine the invalidity of the contract in accordance with Article 135, Section 1 (2). Article 134, Section 1, Sentence 2 remains unaffected.
