On behalf of the German Ministry for Economic Cooperation and Development (BMZ) through its special initiative on displacement the qualifications and employment perspectives for refugees and Host Communities in Ethiopia Programme (QEP) supports the Ethiopian government in the implementation of the Global Compact on Refugees (GCR) by improving employment perspectives of refugees and host communities across the country: in Addis Ababa and in four regions: Somali, Benishangul-Gumuz, Tigray and through a Norwegian contribution in Gambella. The programme establishes linkages between the vocational training sector and the labour market. In 2020 the programme received further funding from BMZ for the implementation of a fourth action field for the institutional anchoring of inclusive vocational training and employment. QEP strengthens the capacities of relevant actors in the sectoral implementation of the new refugee proclamation.

The services delivered by the contractor will contribute to the implementation of the fourth output area of QEP: ‘Capacities of the Ministry of Science and Higher Education (MoSHE) and further relevant actors for the sectoral implementation of the new Refugee Proclamation are strengthened.’ It includes measures on the federal as well as regional and local level (multi-level approach). Important Ethiopian government partners include the MoSHE, the Federal TVET Agency (FTA) and further subordinate authorities such as the Regional TVET Bureaus and selected TVET Colleges, and furthermore the Agency for Refugee and Returnee Affairs (ARRA).
The contractor will align stakeholders and increase cooperation between MoSHE, FTA, and ARRA regarding the inclusion of refugees in the public TVET system. The contractor will here support the definition of a ‘road map’ towards a Memorandum of Understanding (MoU) between these stakeholders and provide advice and support for the development of this MoU as well the development of an action plan for the MoU implementation.
Furthermore, the contractor will support the institutional anchoring and coordination capacities for systematic inclusion of refugees in TVET among MoSHE, FTA and ARRA through the development of a regular dialogue and exchange mechanism between focal points at MoSHE, FTA, and ARRA.
The design and development of supportive legislation to promote the implementation of the new Refugee Proclamation in the sectors of vocational training and labour market inclusion will be supported by the contractor. This includes assessments on existing supportive legislations and gaps as well as process design and advice for supportive legislation and their enactment.
In regards to the accreditation of refugees qualifications cooperation possibilities with the Higher Education Relevance and Quality Agency (HERQA) and other relevant actors should be assessed by the contractor in order to support the revision process regarding accreditation of foreign education certificates as well the current process of determining education levels/prior learning where on formal documentation is available.
Awareness-raising activities as well as capacity-development among regional TVET actors and ARRA concerning the Ethiopian TVET sector, inclusion of refugees in TVET and the new refugee proclamation will be conducted by the contractor. The contractor is responsible to support the clarification of roles, to conduct regional stakeholder dialogues and support the establishment of a knowledge management process on regional level in Benishangul-Gumuz, Tigray and Addis Ababa. Furthermore, the contractor supports the stronger institutionalisation of inclusive TVET training by conducting capacity-building measures, support the inclusion of refugees into regional TVET planning and advice on the implementation of (refugee-)inclusive TVET approaches.
It is possible to continue key elements of the service specified in the tender as part of a follow-on measure within the context of the basic project, if additional funding is available by the commissioning parties of GIZ. Within the framework of the basic project described in the terms of reference, GIZ may award contracts for additional services of this type in a comparable extent to the successful company in this procedure by means of a negotiated procedure without a prior call for competition, or to enter into a follow-on contract. All relevant remuneration items shall be increased proportionately.

According to Article 160, Section 3 of the German Act Against Restraint of Competition (GWB), application for review is not permissible insofar as
1) The applicant has identified the claimed infringement of the procurement rules before submitting the application for review and has not submitted a complaint to the contracting authority within a period of 10 calendar days; the expiry of the period pursuant to Article 134, Section 2 remains unaffected;
2) Complaints of infringements of procurement rules that are evident in the tender notice are not submitted to the contracting authority at the latest by the expiry of the deadline for the application or by the deadline for the submission of bids, specified in the tender notice;
3) Complaints of infringements of procurement rules that first become evident in the tender documents are not submitted to the contracting authority at the latest by the expiry of the deadline for application or by the deadline for the submission of bids;
4) More than 15 calendar days have expired since receipt of notification from the contracting authority that it is unwilling to redress the complaint.
Sentence 1 does not apply in the case of an application to determine the invalidity of the contract in accordance with Article 135, Section 1 (2). Article 134, Section 1, Sentence 2 remains unaffected.
