The multi donor action "Institutional development to modernise waste management in Kosovo", co-financed by the European Union and the German Federal Ministry for Economic Cooperation and Development, and implemented by GIZ supports the Government of Kosovo by increasing the capacities to implement the Kosovo Integrated Waste Management Strategy and support the country"s transition towards circular economy. As part of the technical assistance measure, the project is supporting the introduction of the Extended Producer Responsibility schemes for four waste streams: Waste from Electronic and Electric Equipment (WEEE), Batteries and Accumulators, End of Life Vehicles (ELVs) and Oils.
Description of service deliverables:
To create the necessary pre-conditions for the introduction of the EPR system in the country, the contractor will analyse the current market situation to understand the product life cycle of the four waste streams, including the current legal and institutional set-up to assess gaps in relation to EU acquis and ensure applicability of the legislation. The contractor will identify all relevant stakeholders and actors along the value chain and ensure their engagement throughout the entire process by facilitating a stakeholder dialogue.
Based on the findings, the contractor will conceptualise and design a tailor-made EPR system for Kosovo, including option analysis, business case, legal and institutional framework for the set-up of the EPR mechanism. This is expected to support the Government in the decision-making process to set up the EPR system in the country.
Key work-packages:
1) Develop current situation analysis and pre-design study
The contractor is responsible to analyse the current market situation to understand the product life cycle for four waste streams: WEEE, Batteries and Accumulators, ELVs and Oils. Additionally, the contractor will revise the current legal and institutional framework related to EPR and identify gaps to ensure harmonisation with the EU law and applicability of the legislation.
The contractor is responsible to develop a pre-design study and option analysis for the best suited model in Kosovo to implement the EPR system in a national level. The analysis will serve as the basis to facilitate the dialogue between the public authorities, private sector and other stakeholders.
2) Engaging stakeholders and facilitating dialogue
The contractor is responsible to map out all relevant system actors along the value chain relevant to the four specific waste streams. They shall develop a communication and stakeholder engagement strategy to ensure that stakeholders are properly informed and engaged in the discussion and decision-making process to set up an EPR scheme for 4 specific waste streams.
The contractor is responsible to support capacity building of stakeholders throughout the dialogue process and facilitate dialogue meetings and the decision-making process in close coordination with GIZ.
3) Support the set-up of the legal and institutional framework for EPR
The contractor, based on selection criteria, is responsible to propose three priority waste streams out of the four waste streams assessed to be further developed. For the three selected waste streams, the contractor is responsible to develop a comprehensive implementation plan, including the institutional framework, financial implementation plan and business case.
The contractor is responsible to support the respective Ministry of Environment to draft the legal framework to establish the EPR system and support the political decision-making process to set up the necessary institutional mechanisms.

Context
The multi donor action "Institutional development to modernise waste management in Kosovo", co-financed by the European Union and the German Government, and implemented by GIZ supports the central and local level of government of Kosovo to enhance their capacities in implementing an integrated waste management system. The project supports the introduction of the Extended Producer Responsibility (EPR) scheme hereby facilitating the transition of the country towards circular economy.
The Government of Kosovo with the approval of the Kosovo Integrated Waste Management Strategy 2021- 2030 (KIWMS) aims to develop an integrated waste management system and promote circular economy. To facilitate this transition it is important to develop the preconditions that extend the responsibility of producers to the post-consumer stage of their product"s life cycle.
EPR mechanism ensure that producers carry the financial responsibility, or the organisational responsibility too, for treatment of their used products to internalise environmental costs and incentivise sustainable design and production.. At the EU level, EPR is mandatory within the context of the Waste from Electronics and Electric Equipment (hereinafter "WEEE"), Batteries and Accumulators, End of Life Vehicles (hereinafter "ELV"), and Oils. With the Stabilization and Association Agreement (SAA), Kosovo is obliged to harmonise its national legislation with the EU acquis. Although the national legislation is aligned to a desirable level, implementing and enforcement capacities remain rather limited due to insufficient technical, human and financial resources. No EPR mechanism exists in the country thus impeding the implementation of the "polluter pays principle".
Currently, GIZ is supporting the Ministry of Environment, Spatial Planning and Infrastructure (MESPI) to set up a Deposit Refund System (DRS) for beverage containers. It has been agreed that GIZ will support the MESPI and other stakeholders to ensure that the legal and institutional setup is in place, and further support in the implementation of EPR schemes for four waste streams: WEEE, Batteries and Accumulators, ELVs and Oils
Tasks to be performed by the contractor
The contractor shall develop a tailor-made approach that creates the necessary pre-conditions for setting up an EPR system in Kosovo for four specific waste streams: WEEE, Batteries, ELVs and Oils. The contractor shall be working in close cooperation with GIZ, representatives of the government, private sector, and other stakeholders. The contractor is expected to conceptualise the entire system, including business case, develop the legal and institutional framework and facilitate the stakeholder-dialogue and decision-making process.
Key tasks include:
a) analysing the current market situation to understand the product life cycle for four waste streams: WEEE, Batteries and Accumulators, ELVs and Oils;
b) revising the current legal and institutional framework related to EPR and identify gaps to ensure harmonisation with the EU law and ensure applicability of the legislation;
c) drafting and presenting a pre-design study and option analysis for setting up an EPR system for four waste streams;
d) establishing a stakeholder dialogue (including mapping and engagement plan) between the MESPI, private sector, local authorities, civil society organizations and all relevant system actors, and supporting capacity building;
e) prioritising 3 out of 4 waste streams and developing an implementation plan for setting up the system, including business case, necessary legal changes and capacity development plan for the EPR mechanism and other system actors;
f) Supporting the stakeholder dialogue and decision-making process to set up the EPR system.
Project Objectives
Outcome 1: Institutional development to modernise solid waste management in Kosovo.
Outcome indicator 1.1: Number waste streams regulated with approved implementation plans for application of the Extended Producer Responsibility, compliant with EU regulations. Target: 4 waste streams with approved implementation plans (2023)
Output A: The institutional and legislative framework for the waste management sector have been improved.
Output indicator A.1: Number of drafted implementation plans necessary for implementation of EPR systems for 4 waste streams.

According to Article 160, Section 3 of the German Act Against Restraint of Competition (GWB), application for review is not permissible insofar as
1. the applicant has identified the claimed infringement of the procurement rules before submitting the application for review and has not submitted a complaint to the contracting authority within a period of 10 calendar days; the expiry of the period pursuant to Article 134, Section 2 remains unaffected,
2. complaints of infringements of procurement rules that are evident in the tender notice are not submitted to the contracting authority at the latest by the expiry of the deadline for the application or by the deadline for the submission of bids, specified in the tender notice.
