Abschnitt II: Gegenstand
DESY: Heat Pipe for Ultrasat Camera
DESY is one of the world's leading accelerator centres. Researchers use the large-scale facilities at DESY to explore the microcosm in all its variety. Zeuthen is (besides Hamburg) the second location of DESY, located in the south-eastern outskirts of Berlin. Since 2011, the DESY Zeuthen campus has been profiled as a globally visible center for astroparticle physics. DESY Zeuthen is involved in several international research projects in astroparticle physics.
Ultrasat is an astronomical satellite mission whose wide-angle telescope will perform a deep time-resolved all-sky survey in the near-ultraviolet (NUV). The satellite shall be in orbit in 2024 and will then take data for at least 3 years. The main science objectives of Ultrasat are the detection of counterparts to gravitational wave sources and of supernovae. DESY joined the Ultrasat mission in 2019 and will provide the Focal Plane Array (camera).
Two heat pipes are required to transport heat from the sensor of the camera to a thermal interface provided by the spacecraft. The heat pipes are straight without any bends, and both heat pipes are identical.
The production and delivery of the heat pipes is subject of this tender.

In total 12 single bore heat pipes shall be delivered. With reward of the contract DESY will provide a detailed specification of the interface (e.g. position of the mounting holes). Before manufacturing, the final heat pipe design must be reviewed and approved by DESY. Every single bore heat pipe shall be legibly marked with a serial number to allow tracking of specific heat pipes.

1) The Technical Note lists some options as:
— additional thermal characterization testing according to Section 3.2 of the Technial Note,
— burst pressure testing according to Section 3.2 of the Technial Note,
— bake-out according to Section 3.3 of the Technial Note,
— early partial delivery.
2) DESY reserves the right to reorder additional supplies, which are to be purchased from the contractor (original supplier) and are intended either as a partial replacement or extension of performances that have already been rendered, under the conditions of Section 14 Subsection 4 No. 5 VgV.
Abschnitt III: Rechtliche, wirtschaftliche, finanzielle und technische Angaben
Documents submitted must still be valid; where up-to-date requirements are made, the date refers to the date of publication of this notice (see point VI.5). Applicants must submit the following documents or documents with their application:
PL1. Self-declaration regarding exclusion criteria (Sec. 123, 124 GWB). The form in the application documents shall be used.
PL2. A short description of the company. The form in the application documents shall be used.
In the case of candidate consortia, the requirements set out here apply accordingly to each individual member of the candidate consortia.
DESY reserves the right to request further self-declarations and certificates for tenderers and their subcontractors, if they are eligible for the contract.
WL1. Self-declaration concerning the economic and financial capabilities of the applicant, in particular statement of total turnover of the applicant of the last 3 financial years. The form in the application documents shall be used.
In the case of candidate consortia, the requirements set out here apply accordingly to each individual member of the candidate consortia.
If, for a valid reason, an applicant is unable to provide the required proof, he may demonstrate his capacity by presenting other supporting documents deemed appropriate by DESY. DESY reserves the right to request further self-declarations and certificates for bidders selected at the end of the competition and any subcontractors with the submission of the tender separate request.
TL1. Self-declaration on the annual resources of the employees for the relevant business unit (breakdown commercial, technical, other) in the last 3 years. If the applicant does not yet exist for 3 years, the relevant information for the period of existence shall be provided. The form in the application documents shall be used.
TL2. Experience as a company in projects of similar characteristics in the last 5 years (references). Similar are projects with the scope listed in the contract notice an the Technical Note (production and delivery of space-qualified heat pipe).
The form in the application documents shall be used. Please do not hand in more than 5 projects. The reference projects may have been started, implemented or completed within the last 5 years.
Regarding TL2: At least 3 references must be proven.
Regarding TL2: At least 1 of the 3 references must have been production and delivery of space-qualified heat pipe qualified following ECSS-E-ST-31-02C (or equivalent), specifically extrusion, working fluid and temperature range. Deviations are accepted, if sufficient similarity is proven (e.g. more critical working fluid was qualified).

Abschnitt VI: Weitere Angaben
1) The tender documents must be downloaded from the internet address given in point I.3. Their use is binding. If further information or clarification should be required from the contracting authority during the tender, this additional information will also be published at the above mentioned Internet address.
2) Questions concerning the requirements of this notice and the tender documents should be addressed to DESY via the awarding platform immediately, but no later than 12 July 2021. DESY reserves the right not to answer questions received later.
3) Tenders must be transmitted electronically to the body designated in point I.3) via the awarding platform. Until the deadline expires, tenders are encrypted so that the contracting authority has no access to them. However, the tenderer is free to edit and re-upload his tender to participate within the deadline.
4) The contracting authority reserves the right to request a follow up for incomplete or missing documents in the tender at short notice.
5) The contracting authority reserves the right to cancel the procedure on objective grounds. Claims of the tenderers for compensation are — as far as legally permissible — excluded. By downloading the tender documents, the applicant agrees to this.
6) Candidate consortia must submit, with their request to participate, a legally binding declaration according to the application documents signed by all members and must comply with the requirements stated therein.

The time-limit for appeal is regulated under Sec. 160 para. 3 GWB.
The application is inadmissible if:
1) The applicant became aware of the alleged violation of provisions governing the awarding of public contracts before submitting the appeal and did not object to the contracting entity within 10 calendar days; the deadline stipulated in Sec. 134 para. 2 remains unaffected;
2) Violations of provisions governing the awarding of public contracts which become apparent from the tender notice are not notified to the contracting entity by the end of the period specified in the notice for the submission of a tender or application;
3) violations of provisions governing the awarding of public contracts which only become apparent from the award documents are not notified to the contracting entity by the end of the period specified in the notice for the submission of a tender or application;
4) More than 15 calendar days have elapsed from the receipt of notification from the contracting entity that it is unwilling to redress the complaint.
The above sentence does not apply to an application for a declaration of invalidity of the contract pursuant to Sec. 135 para. 1 no. 2 GWB. Sec. 134 para. 1 sentence 2 GWB remains unaffected.
