50Hertz and the Elia Group is planning to create framework agreements with 3 lots for the development and support of web-based .net applications
Development services for CMS functionality
NQT of 50 Hertz Transmission in Germany and partly remote
Framework agreement with one service provider including a guaranteed call-off value.
CMS functionality – Standard CMS web pages and portals for information purposes:
The supplier of the first lot is required to provide development capacity for web pages with a classical CMS use case. This means that the core functionality is the display and management of creatable content without the implementation of complex business logic. These are mostly websites with lower technical complexity and limited dependencies.
Development services for technical functionality and critical applications
NQT of 50 Hertz Transmission in Germany and partly remote
Framework agreement with two service providers. Mini-competitions to be organized within the bidders over the entire contract duration. The first-ranked Contractor will receive a guaranteed call-off value.
Technical functionality and critical applications:
The supplier for the second lot is required to provide development capacity for components and applications with a higher complexity, both from a business and from a technical perspective. This lot has higher development and support requirements, thus putting more emphasis on finding a service provider who can stem the various technical complexities and bring expertise for the underlying business aspects of certain applications.
Operation services for all applications, websites, portals and components described in Lot 1 and Lot 2

Currently, development and support processes are separated and are performed by different teams. Based on this organisation, the third lot is made to be an independent bid on the SLAs for all applications in lots 1 and 2, whereas lot 1 and lot 2 only contains services for development and integration activities. This unites the operation and support of all applications under a single supplier for lot 3. This single point of contact is beneficial for users and facilitates the management of interfaces and dependencies across the whole spectrum of web applications. Continuation of point III.1.4)
1) 'Current’ means no older than 6 months retroactively from the participation period’s date of expiry;
3) Foreign candidates: in principle, they must submit the required declarations/evidence in English or as an officially certified translation. If a declaration/evidence cannot be provided at all, this must be justified, a comparable explanation/evidence must be submitted and an explanation given as to why there is comparability. In justified cases, a German translation may be used.
4) Bidding consortia: together with the request to participate, they must submit a legally binding, fully filled-outbidding consortium declaration signed by all members. In particular, the aspect whereby the bidding consortium is formed in compliance with antitrust law must be taken into account.
Each member of the bidding consortium must submit the declarations and evidence required under III.1.1) andII.1.2). This applies to a limited extent to the declarations and evidence under III.1.3) if the bidding consortium intends to share tasks and, for example, insofar as certain references can only be submitted by one member of the bidding consortium; the bidding consortium must provide an exhaustive explanation of any limited submission of declarations and evidence in an annex to the bidding consortium declaration. The same rules apply to both bidding consortia and bidders.
Additional information:
(a) Q&A: interested companies can contact the awarding body until 7 days before the end of the application deadline via message over the tender platform. If answers are of general interest, they will be sent anonymously to all participants. All interested companies are obliged to consider these clarifications within their application. Non-compliance can lead to exclusion;
(b)tender documents: contract notice and simultaneously retrievable tender documents provide a full bases in the sense of the legislator, in order to facilitate interested companies the decision over the participation on the tender (see justification to § 41 SektVO).
ARIBA:
The candidate must request, complete and submit by the closing date (see IV.2.2)) the pre-qualification questionnaire with the most actual available data together with the requested documents. The candidates must request the access to the tender on the Ariba platform by sending an e-mail to the responsible buyer (see I.1)) mentioning:
• the name of the legal entity;
• general phone number;
• address;
• VAT number;
• name + email + telephone of the contact(s).
Information to access the tender on the Ariba platform will be provided by email as soon as possible. Candidates are advised to request this access as soon as possible and to click on ‘intend to participate’ in Ariba in order to receive possible clarifications from the contracting entity. Contracting entity doesn’t guarantee to provide the Ariba login details before closing time for candidates requesting their access to Ariba less than 48 hours before closing time. The candidate is solely responsible for requesting the access to the tender on the Ariba platform on time. The contracting entity declines any responsibility in the event of problems with the Ariba platform. Any application not sent correctly via Ariba will be rejected. Precise information on deadline(s) for review procedures:
Deadlines for submitting an application for review stem from § 160 (3) of the German Act against Restraints of Competition. For clarification, this regulation is reproduced in full. 'The application is inadmissible if:
1) The candidate became aware of the claimed violation of public procurement provisions before filing the application for review, but did not complain to the client within a time limit of ten calendar days; the expiry of the time limit under § 134 (2) of the German Act against Restraints of Competition (GWB) remains unaffected;
2) Violations of public procurement provisions which become apparent from the tender notice are not notified to the client by the end of the time limit for the application or the submission of a tender specified in the notice;
3) Violations of public procurement provisions which only become apparent from the procurement documents are not notified to the client by the end of the time limit for the application or the submission of a tender specified in the notice;
4) More than 15 calendar days have expired since receipt of notification from the client that it is unwilling to redress the objection.’
