Abschnitt II: Gegenstand
"Framework contract for euro banknote paper", ECA-2022-011
Bundesdruckerei intends to conclude with five contractors a framework contract for the production and supply of bank note paper for the second series or euro banknotes in order to meet deadlines for the supply of its end customers as under the framework agreements concluded with them.
The maximum amount will be: 100 million sheets ES2 paper.

Bundesdruckerei intends to conclude with five contractors a framework contract for the production and supply of bank note paper for the second series or euro banknotes in order to meet deadlines for the supply of its end customers as under the framework agreements concluded with them.
The contractors undertake to supply bank note paper as specified under this framework contract and pursuant to the requirements of the European Central Bank (ECB) or respectively of the competent European central bank.
Bundesdruckerei will conclude this framework contract with a maximum of five suppliers. Based on this contract, Bundesdruckerei will award individual orders for the supply of certain amounts of deliverables and / or demand for deliverables.
The maximum amount will be: 100 million sheets ES2 paper.
The term will commence with the award of the contract and will end after 1 [one] year. The term will automatically extend for 1 [one] additional year unless Bundesdruckerei refuses such extension 3 [three] months before the end of the current contract year. An extension as under clause 1 will occur a maximum of 3 (three) times, i.e., extensions will allow a maximum contract duration of 4 [four] years.

Abschnitt III: Rechtliche, wirtschaftliche, finanzielle und technische Angaben
1. Completed "Applicant"s self-declaration" specifically including mandatory information on headquarters, tax number and VAT ID, legal representatives, shareholders and amounts of shareholdings, beneficiaries and corporate structure;
2. Trade register excerpt current at the time of the application period and created no longer than six months earlier;
3. Self-declaration on absence of exclusion grounds as based on form;
4. Self-declaration on absence of Russia connection as based on form
Submission of self-declaration on absence of Russia connection, together with participation application is permissible, but not mandatory.
If this declaration is not submitted together with the participation application or later on submission of tender, the principal will demand submission in text form from the bidder designated to receive the contract within a reasonable period. If the declaration is then not submitted or submitted late, the offer will be excluded.
5. Excerpt from German Competition Register and Central Register of Trade and Industrial Offences (not to be provided by applicant)
The principal is required to verify prior to awarding the contract, whether records exist in the German Competition Register regarding the bidder designated to be awarded the contract, so as to examine whether grounds exist to exclude the respective bidder from the award procedure. To this end, the principal will request an excerpt from the German Competition Register for the bidder whose offer is designated to receive the award.
In addition, the principal reserves the right, in the course of the participation competition, to request an excerpt from the German Competition Register for any and all applicants designated to receive a call for tenders.
By the same token, the principal reserves the right to request an excerpt from the Central Register of Trade and Industrial Offences under sec. 150 a of Germany"s Professional Code (Gewerbeordnung, GewO) for these applicants to verify whether there are grounds for excluding applicants.
6. Completed "Applicant"s self-declaration" including mandatory information especially on
a) Net total sales (in EUR) for the past three concluded fiscal years;
b) Net sales (in EUR) regarding performances comparable to the performance object during the past three concluded fiscal years;
Successful supply of paper for production of banknotes corresponding to those set out in the performance description in scope, quality and level of difficulty, will be considered comparable.
7. completed "Applicant's self-declaration" including mandatory information especially on
a) total number of staff employed on average in the applicant's/bidder's business in the last three concluded fiscal years;
b) number of staff employed on average in the applicant's/bidder's business in the last three concluded fiscal years entrusted with performances comparable to the tendered performance object.
Successful supply of paper for production of banknotes corresponding to those set out in the performance description in scope, quality and level of difficulty, will be considered comparable.
8. Accreditation by the European Central Bank (ECB) (not to be provided by applicant)
The principal will verify fulfillment of the requirement under 8. by consulting the ECB's list of accredited enterprises as current at the application period.
Preliminary accreditation will be accepted for participation in the award procedure. Thus, enterprises having received preliminary accreditation may become framework contract partners.
The principal will repeat verification of framework contract partners' accreditation status prior to the individual mini-competitions.

The principal reserves the right to annul the award procedure if only a single participation application is received.

The participation application must be complete and contain the documents set out under number 24 of these conditions for participation. Incomplete participation applications may be excluded from consideration.
The principal may demand at their own discretion that applicants provide declarations and evidence such as have not been provided by the end of the participation period and if applicable do so within a reasonable additional period.

Under this procedure, the online portal "Deutsches Vergabeportal" (http:// www.dtvp.de) will be used for submission of the application for participation and/or for submission of offers as well as for all other steps of the electronic award procedure.
You will be required to submit your application for participation, your offer and your enquiries electronically via the DTVP online award portal. Any additional provisions that may apply hereto are contained in the award documents.

Section 160 Act against Restraints of Competition (Competition Act - GWB)
Initiation of the Proceedings, Application
(1) The public procurement tribunal shall initiate review proceedings only upon application.
(2) Every undertaking that has an interest in the public contract or the concession and claims that its rights under Section 97(6) have been violated by non-compliance with the provisions governing the awarding of public contracts has the right to file an application. In doing so, the undertaking must show that it has been or risks being harmed by the alleged violation of public procurement provisions.
(3) The application is inadmissible if
1. the applicant became aware of the claimed violation of public procurement provisions before filing the application for review, but did not complain to the contracting authority within a time limit of 10 calendar days; the expiry of the time limit under Section 134(2) remains unaffected,
2. violations of public procurement provisions which become apparent from the tender notice are not notified to the contracting authority by the end of the time limit for the application or the submission of a tender specified in the notice,
3. violations of public procurement provisions which only become apparent from the procurement documents are not notified to the contracting authority by the end of the time limit for the application or the submission of a tender specified in the notice,
4. more than 15 calendar days have expired since receipt of notification from the contracting entity that it is unwilling to redress the objection.
Sentence 1 shall not apply to an application under Section 135(1) no 2 to have the contract declared ineffective. Section 134(1) sentence 2 shall remain unaffected.
