Media technology at 50Hertz and Elia
This tender aims to find service providers who can support both refurbishing and maintaining the media installments of both companies and who signs a framework agreement, in Belgium and in Germany, with state-of-the art technology. In both countries this applies to different sites and to building complexes with several meeting rooms of different sizes. The requirements range from equipping small, medium to large sized meeting and conference rooms with screens and projectors, microphones and loudspeakers, as well as webcams. Elia Group requires the
potential Contractor to be a qualified service-oriented partner for purchases and maintenance over the entire course of the contract. During this contract the Contractor also provides support
for minor incidents as well as intervention teams solving emergencies related to the entire installed media landscape.

The aim of the tender is to conclude a framework agreement for the procurement and supply
of media technology components, the integration of these components into the current (IT &
physical meeting room infrastructure) environment, and their maintenance. Event support is
required.
One important aspect of the installation process is to ensure the continued operability of the
media technology during on-going office work. So pre- and after-sales support is crucial.
Elia in Belgium possesses two main buildings in Brussels, and further smaller other locations
in Belgium, one in Antwerp, one in Namur, etc. In total, there are 13 different sites (more details
below).

The aim of the tender is to conclude a framework agreement for the procurement and supply

50Hertz in Germany is based in Berlin with further locations in North and East Germany with
a total amount of 12 different relevant sites.

Abschnitt III: Rechtliche, wirtschaftliche, finanzielle und technische Angaben
Listing and brief description of the rules and criteria:
(a), 2-stage procedure: first, interested parties apply for prequalification. (1st step: application only).
The prequalified candidates are then invited to submit a bid. (2nd step: invitation to submit a bid).
(b), the request to participate must be submitted completely in English or German in electronic form via Ariba.

Commercial register excerpt or comparable not older than 6 months
Self-declaration that there are no grounds for exclusion according to §§ 123 and 124 of the German Act against Restraints of Competition (GWB). This as well refers to a bidding consortium and in cases of loans of eligibility to a third-party company.
1, Professional Liability Insurance: Proof of the insurer about the existence of a professional liability insurance, stating the sums insured (per claim and maximum duration of insurance) for property damage, personal injury and for financial loss or a declaration that the candidate will have a corresponding professional liability insurance at the time of the provision of services.
2, Public Liability Insurance: Proof from the insurer of the existence of a liability insurance, stating the sums insured (per claim and maximum period of insurance) for property damage, personal injury and for financial loss or self-declaration that the candidate will have a corresponding public liability insurance at the time of the provision of services.
3, Revenue Information: The candidate must provide information on the total revenue as well as the revenue of the business with which the subject of the tender is comparable.
4, Business Information/Annual Financial Statements: A current annual report (not older than 6 months) must be submitted.
5, Bank Information: A current report from the company's bank (not older than 3 months) must be submitted. / Submission of a current credit report (no older than 6 months), e.g. from credit reform; if the financial criteria show that the company is too weak, this could lead to exclusion;
All points listed under this Section III.1.2) are minimum requirements.

Continuation of point III.1.4) 'Objective rules and criteria for participation’:
(c) general explanations on the content of the request to participate
1) 'Current’ means no older than 6 months retroactively from the participation period’s date of expiry;
2) If a candidate cannot produce a third-party certificate (e.g. a register entry) as req+uired, a comparable third-party certificate shall be submitted and the comparability demonstrated by means of an appropriate explanation;
(a) questions and answers: interested companies can contact the awarding body until 7 days before the end of the application deadline via message over the tender platform. If answers are of general interest, they will be sent anonymously to all participants. All interested companies are obliged to consider these clarifications within their application. Non-compliance can lead to exclusion;
(b)tender documents: contract notice and simultaneously retrievable tender documents provide a full bases in the sense of the legislator, in order to facilitate interested companies the decision over the participation on the tender (see justification to § 41 SektVO).
The candidate must request, complete and submit by the closing date (see IV.2.2)) the pre-qualification questionnaire (PQQ) with the most actual available data together with the requested documents. The candidates must request the access to the tender on the Ariba platform by sending an e-mail to the responsible buyer (see I.1)) mentioning:
• the name of the legal entity;
• general phone number;
• address;
• VAT number;
• name + email + telephone of the contact(s).
Information to access the tender on the Ariba platform will be provided by email as soon as possible. Candidates are advised to request this access as soon as possible and to click on ‘intend to participate’ in Ariba in order to receive possible clarifications from the contracting entity. Contracting entity doesn’t guarantee to provide the Ariba login details before closing time for candidates requesting their access to Ariba less than 48 hours before closing time. The candidate is solely responsible for requesting the access to the tender on the Ariba platform on time. The contracting entity declines any responsibility in the event of problems with the Ariba platform. Any application not sent correctly via Ariba will be rejected. Deadlines for submitting an application for review stem from § 160 (3) of the German Act against Restraints of Competition. For clarification, this regulation is reproduced in full. 'The application is inadmissible if:
1) The candidate became aware of the claimed violation of public procurement provisions before filing the application for review, but did not complain to the client within a time limit of ten calendar days; the expiry of the time limit under § 134 (2) of the German Act against Restraints of Competition (GWB) remains unaffected;
2) Violations of public procurement provisions which become apparent from the tender notice are not notified to the client by the end of the time limit for the application or the submission of a tender specified in the notice;
3) Violations of public procurement provisions which only become apparent from the procurement documents are not notified to the client by the end of the time limit for the application or the submission of a tender specified in the notice;
4) More than 15 calendar days have expired since receipt of notification from the client that it is unwilling to redress the objection.’
