Since introducing a first local government act for the level of communes and sangkats (C/S) in 2001, Cambodia has been developing its decentralisation reforms in a sequential manner. The transfer of wide-ranging sector tasks to the district and municipality level in December 2019 was the latest significant step in this reform process. The module aims to develop local strategies for selected services (administrative services/One-Window Service Offices, water and waste management) and to capitalise on existing mechanisms for the participation and engagement of citizens and the private sector for the newly transferred functions. The module objective is: districts and municipalities in selected partner provinces use strategies and improved processes for service delivery in priority sectors. The present tender refers to the implementation of Output 2 (one-window service offices) and Output 3 (local water management strategies). It will be implemented in Phnom Penh and 3 provinces (Battambang, Banteay Meanchey, Siem Reap).

Since introducing a first local government act for the level of communes and sangkats (C/S) in 2001, Cambodia has been developing its decentralisation reforms in a sequential manner. The transfer of wide-ranging sector tasks to the district and municipality level in December 2019 was the latest significant step in this reform process. Subordinating many of the deconcentrated line offices at this level to the leadership of the district and municipality governors creates an integrated local administrative structure, allowing elected local councils to set the priorities of action in these sectors and to control the implementation.
Major challenges for the decentralisation reform include connecting political, administrative and fiscal elements of decentralisation, the strengthening of the accountability of the sub-national administration, the creation of effective processes and structures for the provision of sector services with the involvement of the elected councils, and the adaptation of procedures and structures of technical, administrative and legal supervision. There is a lack of standardized and coordinated procedures and processes for the implementation of the sector responsibilities which were transferred to the level of districts and municipalities in 2019. An active support of the Sub-National Administrations by the line ministries (e.g. in the water sector) and by their provincial departments is not yet taking place.
The module aims to develop local strategies for selected services (administrative services/One-Window Service Offices, water and waste management) and to capitalise on existing mechanisms for the participation and engagement of citizens and the private sector for the newly transferred functions. The module objective is: districts and municipalities in selected partner provinces use strategies and improved processes for service delivery in priority sectors. Output 1 aims to strengthen the NCDD in using the recommendations prepared by its Secretariat for the implementation of the decentralisation reform. By supporting the digitalisation of the access to OWSO services and of internal work processes, and by the creation of alternative access routes ("mobile OWSOs" and digitalisation) (Output 2), OWSOs will be able to adequately perform their functions in this new phase of the decentralisation reform and to provide disadvantaged groups with easier access to its services. Output 3 supports selected districts and municipalities in implementing the waste and water management tasks assigned to them at the end of 2019. Output 4 strengthens local councils in their task of conducting a competent dialogue with local government units on sector services, while adequately involving civil society and the private sector.
The present tender refers to the implementation of Output 2 (One-Window Service Offices) and Output 3 (local water management strategies). It will be implemented in Phnom Penh and 3 provinces (Battambang, Banteay Meanchey, Siem Reap).

f more than five candidates/associations are considered suitable, only the five candidates/associations ranked in the top five according to the following selection criteria will be invited to submit a tender. The other candidates/associations will not be invited to submit a tender. This selection will be made under all eligible participants based on the following criteria:
I. Technical experience:
1. Provision of administrative services through One-Stop-Shops (weighting 20%)
2. Digitalisation of administrative services (weighting 10%)
3. Local water management strategies (weighting 20%)
II. Regional experience:
Regional experience in Asia (weighting 30 %)
III. Experience of development projects (ODA-financed):
Experience of development projects (at least 50 % ODA-financed) (weighting 20%)

Abschnitt III: Rechtliche, wirtschaftliche, finanzielle und technische Angaben
The application must be made using the forms provided by GIZ:
1) Trading name and address, beneficial owner(s), commercial register number, bank account, tax number, VAT identification number, brief company profile and contact in event of queries.
2) Extract from the commercial register or equivalent evidence/proof (not older than six months).
3) Self-declaration that no grounds for exclusion in Section 123, 124 of the German Act Against Restraints of Competition (GWB) apply.
4) If a candidate/tenderer wishes to use the capacities of another company for the execution of the contract, he must prove by submitting a declaration of commitment that the corresponding capacities are available to him for the execution of the contract.
5) If subcontractors are to be used, a declaration of commitment and a declaration that no grounds for exclusion pursuant to Section 123 GWB and/or Section 124 GWB apply to them must be submitted.
6) In the case of participation as a bidding consortium: tenderers must appoint a leading member and authorise this member to represent the group and to receive payments with discharging effect also for the other members. A corresponding agreement, signed by all members, must be attached to the application for participation. For this purpose, the form provided by GIZ must be used.
1) Declaration on the average annual turnover for the last 3 financial years (last-but-4 financial year can be included in case of invitation to tender held within 6 months of end of last financial year).
2) Declaration on the average number of employees and managers for the past three calendar years.
1) Average annual turnover for the last 3 financial years: at least 1,300,000 (one million three hundred thousand) EUR
2) Average number of employees and managers for the past three calendar years: at least 15 persons.
It is necessary to provide minimum 3 reference projects in the technical field "decentralized governance of public service delivery" and at least 2 reference projects must be in Asia, each of them in the last three years with a minimum commission value of at least [Betrag gelöscht] EUR.
1) The technical assessment is only based on reference projects with a minimum commission value of 250,000 (two hundred fifty thousand) EUR in the last three years.
2) The minimum requirements forsee at least 3 reference projects in the technical field "decentralized governance of public service delivery" and at least 2 reference projects must be in Asia, each of them in the last three years with a minimum commission value of at least 250,000 (two hundred fifty thousand) EUR.

According to Article 160, Section 3 of the German Act Against Restraint of Competition (GWB), application for review is not permissible insofar as
1. the applicant has identified the claimed infringement of the procurement rules before submitting the application for review and has not submitted a complaint to the contracting authority within a period of 10 calendar days; the expiry of the period pursuant to Article 134, Section 2 remains unaffected,
2. complaints of infringements of procurement rules that are evident in the tender notice are not submitted to the contracting authority at the latest by the expiry of the deadline for the application or by the deadline for the submission of bids, specified in the tender notice.
3. complaints of infringements of procurement rules that first become evident in the tender documents are not submitted to the contracting authority at the latest by the expiry of the deadline for application or by the deadline for the submission of bids,
4. more than 15 calendar days have expired since receipt of notification from the contracting authority that it is unwilling to redress the complaint.
Sentence 1 does not apply in the case of an application to determine the invalidity of the contract in accordance with Article 135, Section 1 (2). Article 134, Section 1, Sentence 2 remains unaffected.
