Abschnitt VI: Weitere Angaben
1) The tender documents (incl. forms and forms in the bidding documents) can be accessed at the Internet address given in Section I.3. The use of the forms and forms in the bidding documents is binding. If further information or clarifications are required by the contracting authorities in the course of the award procedure, this additional information will also be published at the Internet address given there. The bidders must therefore regularly check whether further information has been published at the Internet address stated there. Registration with the procurement platform facilitates access and information to the bidder information.
2) Questions regarding the requirements of this announcement and the tender documents should be submitted via the award platform immediately, but no later than 07.November.2023. DESY reserves the right not to answer questions received later.
3) Bids are to be submitted electronically to the office named in Section I.3 via the award platform. Until expiry of the bid deadline, the bids are encrypted so that the contracting authorities do not have access to them. However, the bidder is free to edit and re-upload his bid until the expiry of the deadline.
4) DESY reserves the right to cancel the procedure for factual reasons, e.g. due to lack of economic efficiency. Claims for compensation by the bidders are excluded - insofar as legally permissible. By downloading the tender documents, the bidder agrees to this.
5) By submitting a bid, the bidder undertakes to treat all documents sent to it, if applicable, as confidential and to maintain confidentiality in all other respects; this also applies with regard to the respective bid. DESY, for its part, will use documents of the bidders only for the purposes of the procedure.

Precise information on deadline(s) for review procedures:
- Section 134 (2) GWB - Duty to inform and wait: A contract may only be concluded 15 calendar days after the information pursuant to Section 134 (1) GWB has been sent. If the information is sent electronically or by fax, the period is reduced to 10 calendar days. The time limit begins on the day following the dispatch of the information by the contracting authority; the day of receipt by the tenderer and candidate concerned is irrelevant.
- The award procedure is subject to the provisions on review proceedings before the Public Procurement Tribunal (Section 155 et seq. GWB). Pursuant to Section 160 (3) GWB, the application is inadmissible if:
1. the applicant has recognised the asserted infringement of procurement rules before filing the application for review and has not objected to it vis-à-vis the contracting authority within a period of 10 calendar days; the expiry of the time limit pursuant to Section 134 (2) GWB remains unaffected,
2. infringements of procurement rules which are apparent from the notice are not notified to the contracting authority no later than the expiry of the time limit for application or submission of tenders stated in the notice,
3. infringements of procurement rules which are only apparent in the tender documents are not notified to the contracting authority at the latest by the expiry of the time limit for submitting applications or tenders,
4. more than 15 calendar days have elapsed after receipt of the contracting entity's notice of its intention not to remedy a complaint. The preceding sentence shall not apply in the case of an application for a declaratory decision on the invalidity of the contract pursuant to Section 135 (1) No. 2 GWB. § Section 134 (1) sentence 2 GWB remains unaffected.
